These Terms and Conditions of Service (hereinafter: Terms of Service) sets out the rules for using the online store available at shop.joannabilska.pl, run by the company Obrazy Abstrakcyjne Joanna Bilska.

The regulations govern:

  • the manner and conditions of use of the website,
  • rules for placing orders and concluding sales contracts,
  • the rights and obligations of customers and the Seller,
  • scope of liability arising from the provision of electronic services.

Before using the store, please read these Terms and Conditions and our Privacy Policy. By using the store, you accept the terms and conditions and agree to comply with them.

Some services offered on the website may be subject to separate terms and conditions – these will be available directly with the service in question.

The provisions of the Terms and Conditions constitute an integral part of the agreement concluded between the Seller and the User.

§ 1 Preliminary provisions

  1. Online store Joanna Bilska Obrazy Abstrakcyjne, available at https://shop.joannabilska.pl, is run by Joanna Bilska, with its registered office at ul. św. Mikołaja 8/11 lok. 208, 50-125 Wrocław.
  2. These Terms and Conditions are addressed to Consumers and define the rules and procedures for concluding distance sales contracts with them via the Store.

§ 2 Definitions

  1. Consumer – a natural person performing a legal transaction with the Seller that is not directly related to their business or professional activity.
  2. Seller – Joanna Bilska, ul. św. Mikołaja 8/11 lok. 208, 50-125 Wrocław.
  3. Customer – any entity making purchases through the Store.
  4. Entrepreneur – an entity making purchases for purposes directly related to its business or professional activity.
  5. Shop – the Seller's online store available at https://shop.joannabilska.pl.
  6. Distance contract – a contract concluded without the simultaneous physical presence of the parties, using means of distance communication.
  7. Terms of Service – this document.
  8. Order – a declaration of intent by the Customer leading directly to the conclusion of a Sales Agreement.
  9. Account – Customer account in the Store; stores Customer data and order history.
  10. Registration form – a form used to create an Account.
  11. Order form – an interactive form used to place an Order.
  12. Cart – a component of the Store's software that displays selected Products and allows modification of Order details.
  13. Product – a movable item or service available in the Store.
  14. Sales Agreement – a contract for the sale of a Product concluded between the Customer and the Seller.

Note: The return address is provided individually after receiving a notice of withdrawal from the contract or a complaint.

§ 4 Technical requirements

To use the Store, you need:

  1. a device with Internet access and a browser (Chrome, Firefox, Safari, or equivalent);
  2. active email account;
  3. cookies enabled.

§ 5 General information

  1. The Seller shall not be liable for any interruptions in the operation of the Store caused by force majeure, the actions of third parties, or the incompatibility of the Customer's equipment.
  2. You do not need an account to browse the product range. Orders can be placed:
    a) after logging into your Account, or
    b) without registration – by providing the data necessary to complete the Order.
  3. Prices in the Store are given in PLN and EUR as gross values.
  4. The information about Products posted on the Store's website does not constitute an offer within the meaning of the Civil Code, but an invitation to conclude a contract.
  5. The total price includes the price of the Product and the delivery cost – it is visible in the Shopping Cart before placing the Order.
  6. If the exact price or delivery cost cannot be determined in advance, the Store shall specify the method of calculation in the Product description.

About Products 

The Store offers handmade paintings, most often painted with acrylic paints on cotton canvases, unless otherwise specified in the description. All paintings are protected with varnish or another specialized coating (e.g., in the case of slag metal). The paintings can be cleaned, e.g., from dust, by gently wiping them with a soft cloth. Do not rub, wash with large amounts of water or a sponge, or use liquid or spray detergents, as this may damage the artwork. Paintings often have structures, cracks, thickening, uneven surfaces and colors that are an integral part of the work. The special features of the paintings are shown in the photos and descriptions in the best possible way. Paintings made with metal flakes (thin metal flakes glued to the canvas with a special adhesive) are protected with a special protective varnish coating. However, it is recommended to handle such works with particular care, especially when touching, rubbing, leaning against other objects, etc., as the metallic coating can be scratched off much more easily than acrylic paint. 

Any mechanical damage to the image surface caused by user negligence is not covered by the warranty, but may be repaired in some cases. If you wish to have the damage repaired, please contact us at [email protected] 

Visualizations are used to show only the potential appearance of the image in a virtual interior, and the exact dimensions of the image are given in its description. When selecting an image for an interior, these dimensions should be used as a guide. Photos and videos of items are taken in the best possible quality, but the actual appearance of the item, especially the colors, may differ slightly from those shown in the photos. This is due to individual equipment settings or the angle of light. The paintings are made on canvases consisting of wooden frames and primed canvas, sometimes also on wooden boards, unless otherwise indicated in the description. These are natural materials that require care to ensure their long-term use. In particular, prolonged exposure to moisture or sunlight, or sudden, heavy flooding, may cause irreversible changes to the item, such as fading, warping of the frames, or changes to the canvas. Any such changes caused by improper use are not subject to complaint. 

§ 6 Creating an Account in the Store

  1. To create an Account, you must complete the Registration Form (first name, last name, email address, delivery address).
  2. Opening and maintaining an account is free of charge.
  3. Login is performed using a predefined username and password.
  4. The Customer may delete their Account at any time by sending a request to the Seller's email address.

§ 7 Rules for placing an order

To place an order, you must:

  1. log in to your Account (optional);
  2. add selected Products to the Shopping Cart and press “Add to cart”;
  3. Go to the order form:
    a) log in or use the “Purchase without registration” option;
  4. fill in the recipient's details and delivery address, select the delivery and payment method;
  5. click the “Order and pay” button and, if purchasing without an Account, confirm the Order by clicking on the link in the email;
  6. make payment within 7 calendar days.

§ 8 Available delivery and payment methods

  1. Delivery method: courier delivery only (prepayment).
  2. Delivery is possible within Poland and the following European countries: Austria, Belgium, Czech Republic, Denmark, Estonia, Finland, France, Netherlands, Lithuania, Luxembourg, Latvia, Germany, Slovakia, Sweden, Hungary, Italy. 
  3. If delivery to another country is possible, please contact the Seller before making a purchase via [email protected] 
  4. Payment methods:
    bank transfer to the Seller's account,
    electronic payments (pay-by-link, BLIK, payment card).
  5. Detailed information about delivery costs and accepted payments is available on the Store's website.

§ 9 Performance of the sales contract

  1. The contract is concluded upon receipt by the Customer of an email confirming acceptance of the Order.
  2. Payment must be made within 7 days of concluding the Agreement – otherwise the Order will be canceled.
  3. The Product is usually shipped within 2-5 business days from the date of payment. In special cases, the order processing time may be extended (e.g., illness, vacation, force majeure, special order, reasons beyond the Seller's control), about which the Seller will inform the Customer by email. Information about planned delivery interruptions will also be available on social media pages and in the Newsletter. 
  4. The cost of delivery shall be borne by the Customer, unless otherwise specified in the Agreement; personal collection is not available.

§ 10 Right to withdraw from the contract

  1. The consumer has 14 days to withdraw from the Agreement without giving any reason, subject to paragraph 9.
  2. The period starts from the moment the Consumer (or a person designated by them) receives the Product, and in the case of multiple Products, from the delivery of the last one.
  3. To exercise the right of withdrawal, the Consumer shall send the Seller an unequivocal statement exclusively by electronic means to the following address: [email protected].
  4. The Seller shall immediately confirm receipt of the statement by email and provide the address to which the Product should be returned.
  5. The address of the registered office provided in these Terms and Conditions is not the address for returns. 
  6. Effects of withdrawal:
    01. The agreement shall be deemed not to have been concluded.
    02. The consumer shall return the Product by courier to the address provided in the reply message to the Customer within 14 days of submitting the statement.
    03. The consumer bears the direct costs of returning the goods.
  7. The refund will be made no later than within 14 days of the Seller receiving the returned Product, provided that the Product is intact, without signs of use, mechanical damage or dirt, and is properly secured for transport. If these conditions are not met, the Seller reserves the right to refuse the return or reduce the refund amount in proportion to the extent of the damage. The Seller will make the refund using the same payment method. 
  8. The right of withdrawal does not apply to:
    01. images made according to the Consumer's specifications or serving to satisfy their individual needs,
    02. Products that have been inseparably connected with other items after delivery,
    03. digital content delivered in a non-material form, if the performance began with the Consumer's express consent before the expiry of the withdrawal period.

§ 11 Complaints (conformity of goods with the contract)

  1. The Seller is obliged to deliver a Product that complies with the Agreement.
  2. The customer has the right to complain about a Product that has been found to be defective or that does not comply with the contract. Complaints should be submitted in writing to the following e-mail address: [email protected]
  3. The complaint should include a description of the non-compliance, the date on which it was discovered, the customer's details, and the request.
  4. The customer has the right to have the product repaired free of charge or replaced if repair is impossible or too costly.
  5. The seller will respond to the complaint within 14 days; failure to respond within this period means that the customer's claims are accepted.
  6. Products returned under the complaint procedure should be sent by courier to the address provided by the Seller in response to the Complaint.

§ 12 Intellectual property

  1. All content on the Store's website is protected by copyright.
  2. The customer acquires ownership of the physical work, but does not acquire the rights to reproduce or commercially use it.
  3. It is prohibited to copy, distribute, modify, download, use, or publish any content from the Store and Website for commercial purposes without the prior express consent of the Seller.
  4. Any actions that violate intellectual property rights will be treated as a violation of the law and may result in civil or criminal liability.

§ 13 Personal data in the Online Store

  1. The Seller is the administrator of personal data.
  2. The data is processed for the purpose of performing the Agreement and, with the Customer's consent, for marketing purposes.
  3. Recipients of the data may be:
    a) courier companies making deliveries,
    b) payment operators handling deposits in the Store.
  4. The customer has the right to access, rectify, delete or restrict processing of his data.
  5. Provision of data is voluntary, but necessary to conclude the Agreement.

§ 14 Final provisions

  1. These Regulations enter into force on August 6, 2025.
  2. The Seller reserves the right to make changes to the Terms and Conditions. Each change comes into force no earlier than 14 days after its publication on the Store's website, unless a different mandatory deadline is provided by law.
  3. Amendments to the Regulations do not affect orders placed before their effective date. The version of the Terms and Conditions in effect on the date of the Customer's order shall apply to such orders.
  4. In matters not regulated by these Regulations, the applicable laws shall apply, in particular:
    Civil Code,
    Law of May 30, 2014 on consumer rights,
    Law of July 18, 2002 on the provision of electronic services.
